Rhodes had paid $30,000 for the rights to use the moniker on merchandise, with the understanding that his own name would be featured more prominently than the “American Nightmare” branding.
Once WWE and Fanatics began producing new apparel, Eisold argued that the designs, particularly the winged skull with stars and stripes, too closely resembled his band’s visual identity. He also stated that some of his fans had bought Rhodes’ shirts, believing they were supporting the musical group, which created confusion in the marketplace.
Eisold initially sought $900,000 in damages and requested a full jury trial.
